He was dismissed by the BDF for allegedly making homosexual advances on soldiers under his command but former BDF Captain Oscar Selgado got vindication in court on Tuesday.
Justice Samuel Awich quashed the July 2002 decision of the Security Services Commission which retired Selgado on the grounds that he had harassed junior officers. Awich also awarded Selgado damages. Still, Awich refused the former BDF captain reinstatement to the BDF. Selgado's attorney Dean Lindo had argued to the court that the act of sexual misconduct had never taken place and illustrated this by pointing to a decision of the Belize Advisory Council which overturned the decision of the Security Services Commission.
Trial Judge Awich also pointed to the fact that Selgado never got a fair hearing before the Security Service Commission, because there was no opportunity for cross examination of his accusers.
It made headlines in October of 2000, when in the aftermath of Hurricane Keith, the Captain was accused of making an advance on a junior officer at Caye Caulker where the BDF had been posted to assist recovery efforts.
