In July of 2010, twenty two year old Arturo Eck was found guilty of strangling his uncle, 49 year old Eugenio Tzul to death and then sodomizing him with an antenna.
The San Joaquin resident was sentenced to life in prison - but today his case was back in the court of appeal. His attorney Simeon Sampson told the court there should have been more evidence about the wire that Tzul was strangled with. Sampson also argued that Ek was drinking at the time and the level of intoxication might have caused him to lose control.
Ek had confessed to the crime.
The court of Appeals has reserved its decision.
