On Friday we reported that Joseph Budna's brother, Desmond Tillett was detained by the police on an allegation of cyberbullying.
Well by Friday night at a little after 9pm he was released, but without his devices and storage accessories.
He was taken to the station under the suspicion that he was the one behind the Ryan Budna Facebook page, but even after finding nothing, he says they kept his devices - and still do up to this hour.
Today we spoke via phone with Tillett who sees it as an act of malicious intent:
Voice of: Desmond Tillett, Brother of Budna
"On Thursday morning and they said they have a warrant. Well, they need to talk to me at the police station. They need to ask me some questions. And if I could have them accompany them to the station, I asked them if I'm being detained or arrested. They said, no, we just need to ask you some questions."
"So we went to the police station and when we went to the police station, when we reached into the compound, I was told by the commanding officer of, I guess, Cyber unit, Juan Garcia, he said that for us to ask you questions, we have to treat you like a prisoner and detain you. And I said, what? Since when? So anyways, let's proceed. And they read me my rights and then they said that they have a report from the commissioner of police, Mr. Rosado, Dr. Rosado, that I am posting to Ryan Budna's profile and they need to ask me some questions about it. So what happened is that they just came up, get a warrant, signed by a JP and come back to my house, get everything that is electronic device, laptop, SD cards, hard drives, phones that weren't even working. They took a total of about 30 items from my house. Even my daughter's laptop that she used for online classes."
"But while given my report, basically the interviewers saw that things still being posted on Budna's profile and including some other news outlets as well. And I asked them, how could I be the one posting things when I'm with you all? And so we just have to proceed with the investigation. We have to package everything and to give us consent, you will get back your devices quick. If you don't, it will take months, maybe a year. And so I just believe it's just malicious."
We did reach out to the compol for a comment but up to news time he had not answered.
