Yesterday, a jury convicted Police Constable Sheldon Arzu for a manslaughter committed while he was on duty. But Constable Aldo Ayuso, who also killed a man in the line of duty, will not face the same fate.
7NEWS has confirmed that in the first week of November, the DPP's office sent an instruction to the police telling them that no criminal charge will be brought against Ayuso. On February 12 of this year, the 29-year-old Ayuso killed 21-year-old Leslie Rogers on Euphrates Avenue when he shot him to the head. At the time, the police said that Rogers had pulled a gun and Ayuso shot him in self-defense. Witnesses in the community said otherwise; they claimed it was an execution. Police say they found Rogers with a loaded handgun; onlookers said it was planted.
The DPP got the file on the 25th of February and took 8 months to review it. In April, after Constable Arzu's charge was upgraded to murder, the Assistant Commissioner of Police attorney Eulalio Cantun told 7NEWS that he doesn't think any charge should be brought against Constable Ayuso. Well many months later, it seems the DPP has reached the same conclusion.
And while Constable Ayuso has been cleared of charges, he hasn't been cleared to go back to work. 7NEWS has confirmed that Ayuso remains under interdiction on disciplinary charges, after a complaint was made that he pulled a gun on a civilian. This is the Second firearm offence he has been accused of since the Rogers shooting. In the first, he was involved in a shooting outside a local nightclub. At the time, reports were, that though under interdiction, he had shot at a group of men with a police issued firearm.
