She said he raped her at knifepoint; he said it was consensual sex, and a jury didn't know who to believe so 38 year old Kenneth Flowers is a free man tonight. After three hours of deliberations, the jury of 7 women and 2 men were unable to agree on a verdict unanimously or by a simple majority, so Justice Michelle Arana declared a hung jury. Flowers appeared undefended and after walking out of court a free man, he told us he is now ready to move on with his life.
Flowers' ex-girlfriend testified that he kidnapped her on April 29th of 2004 and held her in a house overnight where he raped her while holding a knife to her throat. She also said that he threatened to wrap his bicycle handle around her neck. Because it was a hung jury, Flowers can be rearrested and tried again for rape. Prosecutor Marjorie Moyston says that will be depend on the victim's readiness to participate in another trial.
