45 year old Manuel Hernandez only has one arm but that didn’t stop him from raping a 39 year old grandmother. A jury convicted Hernandez of rape and today Justice Herbert Lord sentenced him to 10 years in jail. The rape happened on September 2nd of 2007. The woman says that she was sitting in front of her house with her grandchildren when Fernandez who is a friend of the family arrived. She says Fernandez made sexual advances towards her but she brushed him off.
That’s when his Fernandez - who again only has one arm – grabbed her hand and dragged her to the back of the yard. While being dragged she hit her head on a rock. She briefly passed out and that’s when he raped her. Fernandez took the stand in his defense and said the sex was consensual. A jury didn’t believe him and convicted him. Prior to sentencing – justice lord heard mitigation pleas from five character witnesses.
Fernandez was represented by attorney Marcel Cardona. Crown Counsel Christelle Wilson was the prosecutor.
