Last night we told you that Emil Audinett was shot 9 times during a robbery attempt early Sunday morning at the corner of Banak and Lakeview Streets. We reported that he was on life support – that’s what we heard from police - but the news tonight is that even though he was shot 9 times – Emil Audinett is well enough to have been discharged from the Karl Heusner Memorial Hospital today. He was discharged into the custody of police who allege that he tried to rob a man and that’s why he was shot. But his family disputes that. His sister Sheila Bernardez told us that her brother was an innocent victim.

“Eyewitnesses are saying it was an altneraciton between the two guys after which my brother punched the young man in his mouth and the young man dropped. After which he got up and fired five shots at my brother and the five of them caught him. And then he dropped, he got up and continued run and Mr. Castillo followed him and fired four more shots.”

Keith Swift,
“So you’re saying your brother wasn’t attempting to jack anyone?”

Sheila Bernardez,
“No and there are three witnesses that saw what happened.”

Keith Swift,
“You admit though that your brother did punch the guy but it wasn’t in a robbery attempt?”

Sheila Bernardez,
“And they are saying it is a robbery attempt because the young man alleged that he has lost a cell phone but nothing about the cell phone and now the next media is saying that my brother shot the guy but if my brother had shot back, there would be more shells but different if two of them had different guns. And then first they wanted to charge my brother for robbery with a firearm but if my brother had a firearm, it would have been a shootout. Nobody who saw exactly what happened says that. All we want out of this is justice and for them to come and say exactly what happened because my brother got releeased today and they said they don’t have no charges against he. So they just want to bring up a charge for it to look like my brother was in the wrong.”

So tonight Emil Audinett is in custody at the Queen’s Street Police Station awaiting charges or freedom. And if you are wondering how he survived 9 shots. Well the most serious was the one that hit him in the chest. The other shots hit him on legs and arms.
