Last night we reported that the government had to pay costs for Novelo’s after a hearing on Monday. Well, though that had been widely reported on various media outlets as fact, the fact really is that no costs were awarded.
At the hearing, Justice Samuel Awich explained that the application being sought by Lois Young on behalf of the Department of Transport – which would stop the Novelo’s from flooding its northern routes with buses was unnecessary because it was already implied in the original order given by the court. Awich’s interpretation was that if any operator runs more routes than they are permitted to, the department of transport could then initiate contempt proceedings.
It was agreed that the Novelo’s have permits for 5 regular runs plus 3 premier runs and an undertaking was given that those would be observed.
