BEL and the PUC: they can’t seem to agree on much and there are any number of outstanding issues in court or under discussion at all times since John Avery took over the chairmanship of the PUC. One of the first issues to have arisen were what’s called the 2008 amendment byelaws endorsed by the Minister of Public Utilities – which repealed statutory instrument 141 of 2007. That SI changed what’s known as the full tariff period.

BEL claimed that it was not consulted on the repeal and asked Justice Minette Hafiz to quash those bye-laws. Leave for judicial review was granted in October of last year and today Justice Hafiz in a fifty one page judgement dismissed BEL’s application. It’s a major victory for the PUC but there are many legal battles with BEL still pending.
