We also asked Smith where his client stands with what the Prime Minister has explained as MSC Cruise Lines' interest in buying Stake Bank island.

"Where does your client stand vis a vis the rumored plan - or the Prime Minister has exposed it - to sell to MSC and have them take over the project and resurrect?"

"Well, that is why we're in court. Because our instructions, the instructions from our client, is that he does not believe that it is for a legitimate public purpose and a number of other grounds. And so his position is he intends to challenge that. Without the land being vested in the government, it can't be transferred to MSC or OPSA or Stake Bank or anybody else. So the outcome of this hearing will determine will determine whether the government can, in fact, lawfully take Mr Feinstein's, or constitutionally acquire, compulsorily acquire Mr. Feinstein's 23.4 acres."

"Is your client open to a buyout, to just the government saying, here's the compensation of X million."
