As far as appeals go, the score is now "two-nil" in favor of Juliana Choc as she won another round against the DPP's office.
Choc was charged for killing her newborn baby by dumping him in a pit latrine in Punta Gorda on April 12th. She was first acquitted of the murder of her newborn child in December of 2002. The DPP's office appealed that verdict in March of 2003 and they won a new trial. At that new trial she was facing manslaughter charges but a jury convicted her of the minor charge of concealment of a body of a child. With time already served, Choc was freed.
But DPP Kirk Anderson still wasn't through with Choc and he appealed yet again. His basis for appeal was that the judge at her second trial should not have withdrawn the manslaughter charge from consideration by the jury. But in front of the appeals court Choc's attorney Simeon Sampson didn't have to argue. The judges threw out the case after Anderson could not say definitively that Choc knew she was going to have a baby when she went to the pit latrine.
