They were accused of breaking out of their cell, stealing a warden's gun, and trying to shoot their way out of prison, but 2 inmates will face no penalty for the daring jail break as yesterday the charges were dismissed in Belize City's Magistrate's Court.
That's after prison warden Nick Nicholas got out of jail to testify against them. You may recall that last week Nicholas refused to answer the prisoners' questions in court, and Magistrate Jones remanded him to jail for contempt.
Well, when he got out of jail yesterday, he spoke very freely, but not convincingly enough to earn a conviction. Magistrate Jones concluded that the court was not satisfied with the account of what took place because Nicholas was unable to identify the prisoners, and unable to say whether they were out of their cells. With that, Jones struck out the charges of robbery, burglary, escape, conspiracy and damage to property. With that Marcial Martinez and Juan Perez return to jail to serve out their sentences, while another man who escaped that night, Pablo Martinez has never been recaptured.
