As of right now police are calling it a justified homicide, but tonight the family of a man who was fatally shot after he was caught in the act of burglarizing a home is demanding answers. On Tuesday we told you that 28-year-old James Young was killed by a homeowner who woke up and found him in the lower flat of his home. The homeowner, whose name police have not released, told police that the intruder pulled out a knife and threatened him. That's when he pulled out his licensed nine millimeter handgun and shot the burglar twice in the stomach and leg, he died shortly after at the KHMH. Well tonight we have an update. The deceased's name is actually Ernest Croft. He was killed Monday night but it wasn't until yesterday that his family was informed. His mother Gloria King doesn't dispute what her son did but she says he didn't have to be killed.

"Wednesday I heard he died. I wasn't sure so I came to the morgue to make sure it was my son. When I came to the morgue I saw it was my son in there dead. The police didn't come to me and tell me nothing. I heard they went to my house and they didn't come back and say anything to me. I don't know what is going on. I don't where he got shot. I don't know where he was when he got shot. All I know is that my son is dead. I don't know nothing. All I know is that they told me he is dead and I came and check and it was true."
"He did all kind of bad things, he was mischievous. I talked to him. I don't know what to say because they could have at least broke his foot and call the police. They didn't have to kill him."
Ernest Croft was King's first born child. Police report that in the area of the burglary they found a stash of electronic equipment and clothing. It doesn't appear that police will charge the homeowner who has only been identified to us as a well-known businessman.
