A 33-year-old man accused of molesting his 12-year-old daughter is a free man tonight. The man, whose name we won't disclose to protect the girl's identity, was charged in January of 2004 with incest and his trial in the Supreme Court today was supposed to begin today. This morning after a jury was empanelled, Prosecutor Marjorie Moyston told the court she had no case to present. Justice Michelle Arana instructed the jury to find the man not guilty and he was then free to go. This not guilty verdict means that he cannot be retried for incest based on the same complaint. As we understand it, there was no case to present, because the child's mother did not want the 12 year old to testify against her father.
