David Burgess is dead and his family says he was murdered but today police charged his accused killer, 20 year old Mark Vernon for manslaughter by negligence. Vernon it is alleged shot burgess in his forehead on Saturday afternoon in the Yabra area. Burgess was shot 24 hours after his release from prison where he had been remanded since April for aggravated assault.
So, why manslaughter by negligence? Well Vernon says it was an accidental shooting and the two are known to be associates so pending the outcome of a post mortem the charge against Vernon can be upgraded to murder. Vernon we should note is no stranger to the law. He was charged for the September 30th 2007 broad daylight murder of Curlin Cluck Cluck Felix. Those charges were later withdrawn. Vernon was denied bail.
