Accused killer Kent Pandy is back behind bars tonight. The murder case against the 21 year old fell apart today when an eyewitness refused to testify. Though four witnesses had already been called without the eyewitness, Director of Public Prosecutions Cheryl Lynn Branker Taitt entered a nolle pros. Presiding Judge Herbert Lord dismissed the jury and told Pandy he was freed from the murder charge.
But that was just for a brief moment because Pandy was immediately re-arrested. And tonight Pandy is in even more trouble because the DPP and Police are investigating whether Pandy may have tampered with that eye witness who refused to testify. His mother is also under investigation after she was observed writing down names of the 12 jurors.
Pandy was back before Justice Herbert Lord this afternoon where he denied attempting to suppress evidence. He says he can’t threaten witnesses because he is remanded to prison and has no access to a phone. Justice Lord warned him that intimidating a witness carries a 2 year jail term.
Pandy’s new trial starts on October 27th. He is accused of stabbing Allan Sutherland to death on November 10th of 2006. It was reportedly over a video game which Sutherland went to get from Pandy.
