Considering that he is a Police Constable, Delmar Moguel’s name has been in crime and court news quite a bit over the past nine months. But tonight, the news is that he has been cleared of one of those charges. In May, a fellow constable David Griffith accused Moguel of threatening to kill him. Griffith was conducting a search of Moguel’s vehicle which was the subject of investigation.

But today when Griffith took the stand today in the courtroom of Magistrate Tracy Sosa he told the court that he was only briefly familiar with Moguel. And so Moguel’s attorney Dickie Bradley introduced the question of whether Moguel had been properly identified.

Magistrate Sosa ruled that it was too late for a dock identification and dismissed the case for lack of identification of Moguel. PC Moguel was placed on interdiction when the allegations were made and was receiving only half of his pay. Now that the charge has been dismissed, his attorney says he should be back on the job anytime soon.
