In January, 33 year old businessman Ernest Raymond was charged for possession of a firearm without a gun licenses. But he was acquitted today when his attorney Arthur Saldivar submitted that Raymond had no case to answer. Though Raymond was seen driving the car in which police found the gun, Saldivar demonstrated that the arresting officer did not properly caution Raymond. Magistrate Edd Usher agreed explaining that according to the Judges’ rules whenever a police officer has arrested or detained a person he must immediately inform them of his right to speak privately with an attorney.
Saldivar also demonstrated that there was some confusion as to the brand of the gun and whether or not it had in a clip. He also argued that police had failed to prove that Raymond was actually in possession of the gun, though it was in the car. With all that, Usher agreed that Raymond did not have a case to answer and he was acquitted.
It’s been a good legal run for Raymond, as last Friday a charge of laundering $1.5 million was also dropped due to a lack of evidence.
