In August we told you that 27 year old Edwin "Drive" Flowers and 23 year old Brandon Smith had gotten off murder charges for the killing of 20 year old Randy Coye.
The case was struck out a preliminary inquiry when Chief Magistrate Margaret McKenzie after she upheld a submission by their attorney, Dickie Bradley, that there was not sufficient evidence against them to send the matter up to the Supreme Court.
Well, the DPP thought there was enough evidence so she went directly to the Supreme Court to ask the higher court to review the preliminary inquiry.
That was heard on the tenth of December, 2010 before Justice John Gonzalez. Contrary to what the magistrate had held in the lower court, he found that there was enough evidence for Smith and Flowers to be tried for murder.
Gonzalez committed both men to stand trial, issued a warrant for the arrest of both, and ordered them remanded to prison. It is a very unusual occurrence, but it is permitted and valid. And so police have picked up Brandon Smith but Edwin Drive Flowers is still at large and police cannot locate him.
Three men are currently on remand for the crime. They are 20 year old Kenroy Humes, 21 year old Leon Gray and 23 year old Deshawn Mena.
Coye was bludgeoned with a tombstone and shot at Lord Ridge Cemetery in October 2009. The case is set to come up in the January session of the Supreme Court….
