
A pair of brothers who were allegedly caught with over 16 pounds of weed beat the charge in court today.
35 year old Steven Leiva and 38 year old William Leiva, charged with Drug Trafficking for 7.3 kilos of Cannabis and possession of a controlled drug for 50 grams of Cannabis were acquitted of the charges today in the #4 Magistrate's Court.
After the prosecution closed its case their Attorney Dickie Bradley submitted that they do not have a case to answer to because the quantity of the cannabis was never established and the integrity of the cannabis was tampered with.
Bradley also submitted that the cannabis that was in the suitcase was found in a building that was not connected to his clients and the suitcase was in the name of a person named Quan. Bradley also submitted that the taxi in which the 50 grams of cannabis was found was not brought to the court as exhibit at the trial.
Magistrate Roberto Ordonez upheld the submission and acquitted both defendants.
On February 12th, 2009 the police had a warrant to search for stolen goods at Amelia's Store located at Mile 2 ½ on the Northern Highway. They found nothing incriminating but when they went to a building adjourning the store and forced open a locked door, they found a suitcase with the 7.3 kilos of cannabis. Also they found 50 grams of cannabis that was in a knapsack inside a Geo Prism taxi. In addition the police found $1,544.00 in the glove compartment of the car
