Former CEO of the Karl Heusner Memorial Hospital Dr. AlvarO Rosado was sent home a month after the change of government in 2008. And why not? He was seen as a PUP installed by his friend former Health Minister Joe Coye. But it’s not that simple. Rosado had a contract extending up to 2009 and he sued the KHMH for premature termination.
He claimed $110,000 in lost earnings and allowances plus damages. The KHMH’s board of governors argued that his contract was irregular and void. Well, Justice Minnette Hafiz found that “the contract was not void based on irregularities” and “the decision (by the new Board) not to honour the contract was wrong in law.
That’s one point for Rosado. But is he entitled to damages for the wrongful repudiation of the contract? Justice Hafiz found that find that since the contract was wrongfully repudiated the KHMH is liable to pay damages. And how much are those damages? Well, the judge found that he is entitled to what would have been his salary for the entire year of the contract which is $72,000.
The judge also awarded costs is awarded to the Claimant in the sum of $14,400. A counterclaim by the KHMH based on an unauthorized press conference that Rosado had held was dismissed.
