The government's Miami law firm Hunton and Williams has secured another decisive victory for GOB in the courtroom of Judge Ursula Ungaro Benages. In a 23 page judgement issued today, Benages denied several motions made by Prosser's attorneys asking for a reconsideration of the facts and a new trial.
The judge also ruled that the contempt order against government, which was being charged at US$50,000 a day has been vacated, or to put it in the words of the judgement, "there no longer appears to be a justification for imposing a contempt fine against (the) defendant." It states that "no fines" should be imposed against government.
The declaration is consequential for government because at one point those fines totaled over US$1.5 million and this is the first time Benages has explicitly dismissed them.
