Whose team is he on? That’s what we had to ask after we got news of an affidavit filed by Attorney General Wilfred Elrington which disapproves of a decision made by his own Solicitor General, Tanya Herwanger. The affidavit was filed in the case of the judicial review of the Referendum Act, brought to court by Lisa Shoman. As we reported on May 15th the day it was taken to court, Herwanger agreed to the judicial review.

Well, Prime Minister Dean Barrow told us he wasn’t happy about that and now his Attorney General, who is Herwanger’s boss, has said pretty much the same thing in an affidavit now before the court. The affidavit wasn’t available in the Registry, but special counsel who has been retained by government to handle the case, Lois Young Barrow told us that Elrington’s affidavit affirm s that he was not aware of the claim – and if he had been, he would have told Herwanger not to agree to granting the leave for judicial review.

That affidavit will go before the Chief Justice on Monday when Young-Barrow asks the Chief Justice, and you might want to get your notebooks out for this one, for leave to appeal his decision to grant leave for judicial review. We’ll tell you how that goes next week.
