On Monday Justice Minette Hafiz Bertram extended the injunction barring the government from granting a port license to Mike Feinstein’s Stake Bank Project. But Feinstein’s position is that he doesn’t even need a port license; he can use the one his partner Royal Caribbean has at the Fort Street Tourism Village. But can that license be assigned? That’s a point of bitter legal contention between Feinstein and Espat’s Port of Belize and now 7NEWS has obtained a legal opinion advising the BTB on the matter.

According to attorney Elson Kaseke, the agreement between government and the Fort Street Tourism Village does not prevent the village from assigning rights and licenses under the project. Kaseke’s opinion states, “the Fort Street Tourism Village (can) assign its rights and license...to the developer of the Stake Bank Project – in which event there will be no need for the Stake Bank developer to apply for a license from the GOB.“

He concludes, “this will render the injunction useless.” Of course, Espat’s Attorney Eamon Courtenay has told us he is of a decidedly different opinion.
