He was convicted of murdering a businessman and was sentenced to hang for his crime and there will be no reprieve for Erlin White.

Today the Court of Appeals agreed that white should get the death penalty for murdering Dwayne Arnold in February of 2002. White was convicted last October for the murder and was sentenced to death by hanging four days later.

Today his attorney Simeon Sampson argued before the Appeals Court that the sentence should be overturned because there is strong evidence to suggest his client is a victim of mistaken identity and Sampson argued that trial Judge John Gonzalez erred when he didn't stress that point to the jury.

But all three judges on the court appeal, President Elliot Mottley, Manuel Sosa, and Boyd Carey disagreed and upheld the lower court's judgment.
