It would have amounted to another salacious headline, a grown man accused of buggering a 9-year-old boy.

But today the courts took a different view, drawing the line between a mischievous report and a guilty beyond reasonable doubt. The 39 year old security guard, whose name we are not releasing, was arrested for sodomizing the 9 year old boy in October of last year. The boy's mother made the report to police and based on that report alone police went ahead and charged the man with aggravated assault.

But when the case came to trial before Magistrate Margaret Gabb-Mckenzie she dismissed the case and found the accused not guilty. McKenzie pointed out that the child did not make the complaint, it was the mother and secondly the child could have forced to go along with his mother's story. And then there was the medical report from a pediatrician, which showed no evidence of penetration or even an attempt to sodomize the child.

Now there is a possibility the mother could be charged for perjury.
