Well-known police constable Kevin "cowboy" Alvarez who made headlines when he was charged with shooting to death Albert Pennil is free tonight.

Cowboy walked down the steps of the Supreme Court a free man after DPP's office entered a 'nolle prosequi.' Prosecutor Carlo Mason was unavailable for comment today and no one from the DPP's office would comment on the case. But a 'nolle proseque' normally indicates that the prosecutors aren't ready to proceed with their case.

Cowboy was indicted on a charge of manslaughter by Magistrate Dorothy Flowers last October for the December 30th, 2002 shooting of Albert Pennil. Cowboy was originally arrested along with his brothers Jason and Apolonio Hernandez. The charges against them were dropped in September of 2003.

'Cowboy" Alvarez is on interdiction and again it is a possibility he can rejoin the police department.
