They've been on remand for murder two years and tonight two accused murderers are free after the case against them was dismissed.
Clifford Hyde and Tyrone Smith, were accused of killing Derry Bennett in Roaring Creek in February of 2002. The prosecution called four witnesses, one of them who said he simply had no recollection of the event. With that the prosecution rested and defense attorney Lutchman Sooknandan made a no case submission. The judge agreed and declared them free to go.
When the murder occurred in 2002, it was sensational news as Bennett's home was set his house on fire at 3:45 am on February 8, 2002, and when he came out, he was shot dead.
It is uncertain if the DPP's office will reintroduce the murder charges, after the accused spent two years on remand only to have the case fizzle away in the courtroom.
