It took a while for the DPP's office to get its case together and for police to locate him but tonight Mark Gardiner is back in jail awaiting trial for killing Gregory Batty at a football game in March of last year.

You may remember Gardiner has been before a judge and even a jury before in connection with the same death but prosecutors entered a nolle prosequi and a jury found him not guilty. In fact just last month a new trial granted by the Court of Appeals was supposed to begin in the Supreme Court but he was never even summoned. Today though, it went through the proper procedure beginning with an arraignment for manslaughter in front of Magistrate Dorothy Flowers. No plea was taken and Gardiner was remanded until next Friday July 23rd. Gregory Batty was killed during a high school football game at the MCC grounds on March 14th Of 2003.
