With a street name like "Tuba" you'd expect him to be slippery today the man who goes by the moniker managed to slip off a rape conviction. 28 year old Rudolph Hildebrandt Smith, appeared before to hear the appeal of a rape conviction which was handed down on may 14th. After hearing the evidence, and noting discrepancies, the three judge panel withdrew the 20 year sentence that had been passed against him. The 14 year old who had accused Tuba of rape had given the police a description of her attacker in which she said he had missing front teeth. At the trial she was unable to recall whether it was the top or the bottom teeth that were missing. Added to that she had given the police the color of the attacker's shirt which did not match that which Smith had on when he was caught. Of note is that Smith has previously been acquitted of two other rape charges in the magistrate's court.
