Today accused killer Denvoy Gilbert Domingo was released and then re-arrested for the same murder. Domingo had been remanded since September of 2007 for the August 29th 2007 murder of 27 year old Jerry Smart. Smart was standing near his home at the corner of Fuller’s Alley and Cemetery Road when two men on bicycle rode up and opened fire. Smart received fatal gunshot wounds to his back.
Domingo was identified as one suspect but the other is still on the run. The Director of Prosecutions doesn’t want to proceed with a trial until both suspects are in custody and that is why the matter was struck out.
So this morning Senior Magistrate Dorothy Flowers told Domingo the charge was dropped but he was almost immediately re-arrested by officers from the Crimes Investigation Branch. Once the second suspect is picked up, both men will be charged and tried jointly for Smart’s murder.
