The well known Gilly Franklin spent the Tenth on remand because police say his 9 millimeter pistol was licensed but the extended clip for it was prohibited. Well it turns out, that was a misunderstanding of the law. And today the case against the 34 year old went through the door after there were many discrepancies in the handling of the case, including the possibility of the evidence box being tampered with. And more than that, the two main witnesses for the police prosecution case gave sworn statements speaking about two different extended clips, when there only one was in question.
But which was it? Detective Constable Edison Palacio spoke about a Glock brand clip, while the Department Firearm’s Examiner, Orlando Vera spoke about a Scheirer brand clip with another serial number. The discrepancies caused matter be dismissed was and Franklin was cleared of charges.
