Accused killer Mark Medina ran out of the Supreme Court this morning after the murder charge against him was withdrawn. Medina was charged for the callous May 20th 2007 murder of Chinese businesswoman Cuisi Zhou Xiu. She was the Chinese grocer who was shot in the face and died.
The case for murder against Mark Medina fell apart because the crown’s star witness has refused to testify. Eight witnesses had been called but the prosecution needed the eyewitness testimony. And so without it, this morning Crown Counsel Trienna Young entered a nolle pros. That means Mark Medina is free for now. He ran out of the courtroom immediately after the charge was withdrawn.
Bing Xiu who fled the country after his wife was killed also wasn’t here to testify and the prosecution tried unsuccessfully to get his statement admitted into evidence. But the case against Medina seemed airtight because the stolen cash and a gun was found on him when police searched his home Berkeley Street shortly after the incident.
Medina had also allegedly shot Xiu’s daughter in the eye and Xiu’s son four times. Both survived. The DPP’s office withdrew the attempted murder charges against Mark Medina and decided to prosecute him only for the single count of murder.
