He was convicted of rape and sentenced to 9 years in jail, but Lewis Leiva known as DJ Wiz is a free man tonight – free on bail, at least. That’s after a decision today by the court of appeals to grant him a new trial. The Court of Appeal quashed the 38 year old’s conviction, set aside his sentence, and ordered a retrial. Leiva’s attorney Simeon Sampson successfully argued that the trial judge at Supreme Court erred when he did not allow the jury to assess the intoxication of the victim – because it was such that it could have impaired her judgment. The panel of judges agreed and granted a retrial with Leiva free to go on five thousand dollars bail.
At the Supreme Court Leiva had admitted having sex with the girl an American visitor but he said it only went on for thirty seconds and that she gave her consent even though she was intoxicated.
