And another element which Courtney refers to as a joke is that fact that counsel for Budna, represented today by Arthur Saldivar is playing what he characterized as games in court:

"The point of the matter is this, you see I have a constitutional claim, my rights have been breached. I say you have made no allegation against my client and your response is on the day when that is going to be heard, I won't tell you who those witnesses are but if you don't strike it out I will bring them. We are not playing hopscotch, we are not playing jacks, this is a serious matter and we are in a court of law. And Mr Budna must present his evidence now for the judge to determine whether or not to strike out the claim. That is the allegation that we made that it should be struck out, you can't say well I have the evidence but I won't show you."
