It was expected this morning, but Chief Justice Abdulai Conteh added to the suspense surrounding BTL when he deferred delivery of his determination on the BTL Articles of Association. It's viewed as a pivotal and much awaited decision because, essentially, it will determine if Jeffrey Prosser is, first, entitled to two 'C' directors and second, whether he is even entitled to hold the special share which entitles him to another two directors.

If the Chief Justice finds for Michael Ashcroft's E-com and the Government of Belize, it will mean that Prosser could be found to have no standing for all four directors and no place on the board of directors, even if he has invested $30 million in the company and covered another $26 million for Intelco's debt.

Still, we gather that the possibility of an adverse judgement hardly matters to Prosser as he continues to rely on Miami Federal Judge Ursula Ungaro Benages who has said she will not be swayed by any "parallel litigation" in other jurisdictions. In her findings, she maintains that Prosser is entitled to four directors.
