The appeal against the Chief Justice's benchmark April judgement on the proper composition of the BTL Board of Directors was heard today. Jeffrey Prosser's company ICC requested the appeal and shuttled in two Caribbean attorneys to assist Prosser's local attorney Lionel Welch. Prosser's case was presented by Richard Mackfood who argued that the Chief Justice's ruling is flawed because he failed to differentiate between the provision for the appointment of directors and the provision for the removal of directors. Mackfood contended that that in his ruling the Chief Justice basically re-wrote the company's law by confusing the removal of old directors with the appointment of new ones. After a full day, three Appeals Court Justices will continue to hear the case tomorrow. Government is represented by Solicitor General Elson Kaseke and Michael Ashcroft's E-com is represented by Lois Young Barrow.
