Former Social Security GM Narda Garcia had a major victory in the Court of Appeals today. Seen here leaving the courtroom with her husband Greg Garcia and sister in law Dolores Balderamos Garcia, Garcia asked the court to review her case against the report of the Hulse Senate Committee which the chief justice threw out last year. At the time, the Chief Justice said that it was because parliament had certain privileges that the court could not over-rule.
Her attorney Elson Kaseke argued to the Appeals Court that those privileges have limits and did not extend to Garcia. After a full day of very technical arguments, the court agreed and overturned the decision of the Chief Justice. They ruled that leave should be given to review the Senate report as it relates to Garcia and that the CJ should now proceed to hear the case on its merits.
And while the Senate report stands, it's a major victory for Garcia, because once the court has the right to review the Hulse report her attorney is confident that it will be proven to have denied her natural justice.
