And the other side of the argument is to prove that the stevedore strikes were unlawful, and incurred undue economic losses for the port. They argue that it's not about the right to strike, it's about the right to strike lawfully for an essential service.
And because the CWU didn't go through the proper procedures there, attorney Hector Guerra says that the CWU shouldn't be afforded any protections.

"So moving forward the judge naturally has reserved her ruling, these are weighty legal matters and so she has advised that she will provide a ruling before the end of May and after which if she rules that they do enjoy statutory immunities then the matter would come to an end but if she doesn't and which we, of course, are strongly arguing that she shouldn't enjoy any statutory immunities for an unlawful strike then the matter proceeds into hearing evidence from witnesses etc."
