And while the current PUC Chairman ducked out of that press briefing - the former Chair John Avery says he feels the consultation about dominance is to facilitate BTL's acquisition of SMART:

"But it seems to me that the reason they are doing this is to facilitate this acquisition of Speednet by BTL by alleviating certain fares that BTL could take advantage of its position they are saying no we will impose, we will make regulations and then we will set the rates so that you don't have to worry that BTL will try to take advantage. However in my opinion this has nothing to do with the current issues, BTl acquiring speednet has nothing to do with the rates. Even if they determine that BTL is a dominant provider and speednet still exists you can go ahead and make these regulations and then you would be setting rates for both Speednet and for BTL. So this has nothing to do with the acquisition thing in fact I would argue that if you determine BTL is a dominant provider that makes it even more egregious. What BTL is trying to do."
