Mark Gardiner: his name has been in the news a lot recently. In March of 2003 he was charged for killing Gregory Batty at a high school football game at the MCC Grounds. And then earlier this year he walked free from those charges when prosecutors entered a no case submission (Mark Gardiner Walks). Gardiner was a free man and legal observers said there was no way he could be retried for Batty's death. Well in June the DPP Kirk Anderson appealed and he was granted a second shot at Gardiner. Well that second trial was to come today and in Supreme Court number 2 there was a jury, judge, a prosecutor, and a defense attorney all ready; only one thing was missing, the defendant.

Where was he? Well in a royal blunder he was never re-arrested, and never had the charges against him re-instated. In fact, Prosecutor Carlo Mason wasn't even sure if Gardiner was subpoenaed. The presiding Judge John Gonzalez has postponed the case until Mark Gardiner is located, arrested, and charged, which all has to happen before he is tried.

Of note is that Gardiner's previous attorney Linsbert Willis appeared in court today to say he will not be representing Gardiner in the new trial. The victim Gregory Batty was shot to death at the MCC grounds on March 14th of 2003.
