Commission of Inquiry Chairman David Price has filed a complaint with the DPP, but prosecution against DFC General Manager Troy Gabb will not proceed until sometime after next week Monday. What's the holdup? Well today in chambers before Justice Sam Awich, Solicitor General Elson Kaseke gave that undertaking after the DFC Attorney Michel Chebat filed an application before the court. Chebat is asking the court to clearly establish the standing of DFC employees vis a vis the secrecy clause of the DFC Act. Under the wording of the act, they would be subject to prosecution if they disclosed confidential documents. Chebat is asking the court to clarify the position, so that DFC employees know if they can proceed to make disclosures without fear of prosecution. The Chief Justice is expected to hear this matter on Monday.
