On October 6th, viewers of this newscast saw Dion Zabaneh angrily vent on anyone who would stop him from reclaiming a sea front lot in the name of his mother Primrose Gabourel. Well, someone, specifically David Medina Sr., the man who would be denied of his sea frontage, did stop him shortly after that, and that's where the matter has rested for the past month.
But today it went before the Supreme Court. Justice Samuel Awich this evening ruled on an application by Primrose Gabourel to lift an interim injunction on the reclamation of parcel 4670 in the Buttonwood Bay area of Belize City. Awich ruled that the injunction remains in place until the substantive case can be heard.
David Medina claims that he had been paying for a parcel of land immediately in front of his current property only to find out that Gabourel is now claiming that parcel of land within a larger parcel which she holds as property. It's a matter that will only be resolved during a full trial and today Awich pointed out that a respondent in this case must be the Lands Department that double booked the land and which is now party to the case. A representative from Lands will be expected to appear at the full trial.
Awich also indicated that if the injunction was frivolous both Medina and the Lands Department may be liable.
