And today the commissioner confirmed that indeed police are not taking up that request for a summons. He says he wants to hear what the high court says and seemed to question the lower court's order:

"I am somewhat aware of the incident and the court order. I don't want to criticize the court system. But respectfully, the Families and Children's Act, I believe, Section 3, if I'm not mistaken, speaks to the fact that the court must always make decisions in the best interest of a child, which means that the safety and interests of the child must always be paramount."

"And I believe that it is on that premise that human services is appealing the decision of the magistrate. Because if this child was the mother for a period of time, and I believe that that was the second occasion that the stepfather had injured that child, I don't think that it would be in the best interest of that child to return the child to the parents."

"Unless, perhaps, the mother and that stepfather had separated. And maybe the mother had gone through some degree of counseling, or as the case may be. But again, it's a matter for social services. I don't think that they are wrong to appeal the decision."

"I think it's the right thing to do. And then we see what the appeal court will say about it."
