And, in news out of the High Court, a strong decision was handed down blaming the Prison for causing the death of a diabetic inmate.
That was Jahan Abadi, who was serving a 6 year sentence for abatement to murder who died in 2019, less than a year after he was incarcerated.
The Abadi family retained Leeroy Banner to sue the government and the prison. And, earlier this week a judgement was handed down saying they won.
Justice Hondora found, quote, "Mr Abadi's death was caused by the wrongful acts of the prison authorities and that the defendants are vicariously liable. For completeness, I rule that prison authorities have a positive obligation to treat and provide medication to prisoners and where they do not have the capacity, resources and/or expertise, they have an obligation to ensure that prisoners have access to treatment and medication provided by the public hospital system...the defendants had a duty of care to Mr Abadi, which they breached and that their actions and omissions were wrongful, which led to his death, I hold that the claimants have demonstrated that they are entitled to claim damages " End quote.
The court urged the government to reach a settle3ment with the family - which they have.
