Yesterday Attorneys for Jeffrey Prosser's ICC filed an action in U.S. Florida Courts asking that the per diem fine that is currently running against the Government of Belize be increased from US$50,000 a day to US$100,000. Prosser's attorneys contend that the latest actions by the Government of Belize which passed an amendment to the PUC Act goes against Miami Judge Ursula Ungaro Benages' ruling of March 30th.

In this latest legal move ICC's attorneys use the injunction order quoting that "ICC's two directors appointed pursuant section 88(a) of BTL's Articles of Association shall remain in place" meaning the two board directors appointed by the holder of the Special Share and "neither party shall cause, or, to the extent within the party's control permit BTL to issue, purchase, redeem, or cancel any shares or stock of BTL, including without limitation, preferred shares or stock, unless both parties agree in advance in writing." ICC's legal team asks that_ "the court should send a clear message that the government will continue to face dire consequences should it proceed on its current course of contempt." Those dire consequences now may mean that Belize's government pay US$100,000 a day for contempt of Benages' court

As it presently stands the US$50,000 meter is still running and by our count it's been 134 days since Benages' ruling. At US$50,000 a day, what is payable to the Florida Court by GOB is in the region of US$6.7 million or BZ$13.4 million.
