Today the Government of Belize went to the Court of Appeal to ask it to put a hold on the Chief Justice's explosive judgement against the government. As we've reported, the Chief Justice ruled that government had acted unconstitutionally when it cancelled BTL's Special Share and threw out its Articles of Association. The effect of the September 19 judgement, is that that it restored Jeffrey Prosser and Bobby Lubana as directors BTL's Board.
Well now the Attorney General Francis Fonseca has said in an affidavit that this judgement is seriously affecting BTL's operations and is asking the court to enact a novelty in law, called a stay of operation - which would prevent the judgement from taking effect. Government's attorney for the matter, Elson Kaseke presented the arguments to the Court of Appeal bench which said it was wary to grant such a stay.
After 3 hours of hearings, the Court agreed that it would give BTL's attorney Rodwell Williams a week to present affidavits from his client showing how the judgement is affecting the company's operation. After those are presented, hearings will resume.
ICC was represented by Lionel Welch - who still has not filed contempt proceedings against BTL. He says he has not been instructed by his client to make the filing, which tells us, much larger negotiations are afoot.
