Will the wall at the Tourism Village have to come down or not? That's the question that the Chief Justice has now reserved judgement on. After three days, arguments from 5 attorneys concluded and the Chief Justice has commenced deliberation.
It's a thorny and complex matter, and basically the Chief Justice will have to decide if the wall infringes on the constitutional rights of the Harbor View Restaurant and Michael Colin Gallery on one side and the Brown Sugar Marketplace on the other. But beyond port regulations, it's a matter of private property versus public authority because essentially, the wall is the private property of the Fort Street Tourism Village.
As we said, a complex case, and the Chief Justice has set no date for his judgment.
