On Tuesday, we told you about the order that the Public Utilities Commission was scheduled to issue today commanding BEL to comply with the conditions of its license, particularly as it regards new power installations, or as it’s called technically, “reasonable requests for service.”

But BEL today went to the Supreme Court to request an injunction, blocking the PUC from issuing that order. Michael Young appeared for BEL and Andrew Marshalleck appeared for the PUC before Justice John Muria to make presentations. BEL’s argument is that the order was an extension of an defective decision by the PUC, which is currently under appeal. The PUC’s response is that it is in fact a separate issue and one that can proceed in the normal course. With the matter pending in court, the PUC was prevented from issuing the order as scheduled today.

Late this evening, Justice Muria made his decision, and refused to grant the injunction. That clears the way for the PUC, and on Monday the regulator is expected to issue its order.
