Last week we told you that 3 new judges of the Court of Appeal had been sworn in.
But, the opposition says when they saw it on the news that was the first they had heard of it.
Now, that's odd because the constitution says that Justices of Appeal must nee appointed after consultation with the leader of the opposition.
Well, in the past two months, the UDP has had two of those - but neither of them, Shyne Barrow nor Patrick Faber say they were consulted.
Well, it turns out they were. Kinda-sorta. Patrick Faber says he got a letter by email - which had slipped him when it was sent one month ago because it supposedly went into his junk mail.
But, does an email without any follow up even constitute consultation? We asked the UDP Chairman via zoom today:

"As it turns out an email was sent to Honorable Patrick Faber on June 21st. It went to his junk-mail and that email contained a letter that was signed on June 7th - so two weeks after a letter is signed by the Cab Sec, the office of the Prime Minister, it is emailed to the Leader of the Opposition at the time Patrick Faber, no follow up phone call; no alert; no hard copy was sent, at least we haven't received any. And on that basis three Justices of Appeal were appointed to the court. One can say that we can't say they didn't send us an email, however, I don't think that at least doing an alert or not hearing from us they would at least call to see if there would be a response which is usually the case - that not having happened then we think that the consultation process, to put it mildly, was very weak at best."
